FalcoAlgo, operated by Falco Systems LLC ("we," "us," or "our"), operates falcoalgo.com (the "Site"). This Privacy Policy describes how we collect, use, and share information about you when you use our Site and services, including when you interact with our advertising on third-party platforms.

1.1 Information You Provide
We collect information you provide directly to us, including:
- Name and email address when you subscribe to a strategy or contact us
- Payment information (processed by Stripe — we do not store card details)
- Messages and inquiries submitted through our contact form
1.2 Information Collected Automatically
When you visit our Site, we automatically collect certain information:
- Log data (IP address, browser type, pages visited, time spent on pages)
- Analytics data through Google Analytics 4 (GA4)
- Advertising and conversion data through the Meta Pixel and TikTok Pixel, including device and cookie identifiers
- Advertising click identifiers (such as
fbclid,gclid, andttclid) and UTM campaign parameters, which we store in a cookie for up to 90 days to attribute conversions to the campaign that referred you - Affiliate referral data through our custom affiliate tracking system
- Cookies and similar tracking technologies
1.3 Information Collected Through Advertising and Lead Forms
When you submit your information through a form hosted on a third-party platform — including lead forms on Meta platforms (Facebook and Instagram) — we receive the contact details you provide, such as your name and email address. We use this information in the same ways described in this policy: to respond to your inquiry, send you information about FalcoAlgo, and provide the materials you requested.
We also use advertising and analytics tools, including the Meta Pixel and the TikTok Pixel, to measure and improve our advertising. These tools collect device and usage identifiers and share them with the relevant advertising platform to attribute conversions and build advertising audiences (see Sections 3 and 10). You may opt out of marketing communications or request deletion of your information at any time using the contact details below.
2. How We Use Your Information
We use the information we collect to:
- Process subscriptions and deliver algorithm files and supporting materials
- Send transactional emails (subscription confirmations, receipts, support responses)
- Respond to inquiries and provide customer support
- Send you marketing and promotional communications about FalcoAlgo, which you can opt out of at any time
- Measure, attribute, and improve the performance of our advertising and marketing campaigns
- Analyze Site usage to improve performance and user experience
- Track affiliate referrals for our affiliate program
- Comply with legal obligations
3. Sharing of Information
We do not sell your personal information. We may share information with:
- Stripe — payment processing. Stripe's privacy policy governs their use of your payment information.
- Google Analytics — website analytics. Data is anonymized and aggregated.
- Meta Platforms, Inc. and TikTok — we use the Meta Pixel and TikTok Pixel for advertising measurement and audience building. These platforms receive event and identifier data as described in Section 1.3, and their respective privacy policies govern their use of that data. This activity may be considered "sharing" for cross-context behavioral advertising under certain state privacy laws — see Section 10 for how to opt out.
- Formspree — our contact form is processed by Formspree, which transmits the name, email address, and message you submit to us. Formspree's privacy policy governs their handling of that data.
- Affiliate tracking — our custom affiliate system records referral cookies and click data for commission attribution. Referral data only; no PII beyond email for commission tracking.
- Legal authorities — when required by law, court order, or to protect our legal rights.
4. Cookies
We use cookies and similar technologies for analytics, advertising and marketing measurement (including the Meta Pixel and TikTok Pixel), affiliate tracking, and to improve site functionality. Advertising cookies allow us and our advertising partners to attribute conversions and show you relevant ads on other platforms. You can control cookie settings through your browser, and you can opt out of advertising cookies as described in Section 10. Note that disabling cookies may affect site functionality.
5. Data Retention
We retain your personal information for as long as necessary to provide our services and comply with our legal, accounting, and regulatory obligations. In particular:
- Subscription and billing records are retained for a minimum of 7 years to satisfy IRS and applicable tax recordkeeping requirements.
- Support correspondence is retained for up to 3 years from the last interaction.
- Marketing-list data is retained until you unsubscribe or request deletion.
- Affiliate referral records are retained for the duration of your participation plus the period required to settle commissions and chargebacks.
You may request deletion of your personal information at any time, subject to records we are legally required to keep.

Depending on your location, you may have rights to:
- Access the personal information we hold about you

- Request deletion of your personal information
- Opt out of marketing communications
- Data portability (where applicable)

8. Security and Breach Notification
We implement reasonable technical and organizational measures to protect your personal information, including TLS encryption in transit, restricted access to subscriber records, and tokenized payment processing through Stripe (we do not store card data on our systems).
No internet transmission or storage system is completely secure, and we cannot guarantee absolute security. In the event of a security incident affecting your personal information, we will notify affected individuals and applicable regulators as required by law (including state breach-notification statutes such as Virginia Code § 18.2-186.6 and California Civil Code § 1798.82) without unreasonable delay.
9. Third-Party Links
Our Site may contain links to third-party websites. We are not responsible for the privacy practices of these sites and encourage you to review their privacy policies.
10. California Privacy Rights (CCPA / CPRA)
If you are a California resident, you have the right to:
- Know what personal information we collect, use, and disclose about you
- Request deletion of your personal information
- Correct inaccurate personal information
- Opt out of the sale or sharing of your personal information
- Limit the use and disclosure of sensitive personal information (we do not use or disclose sensitive personal information for purposes that would trigger this right)
- Not be discriminated against for exercising your privacy rights
Cross-context behavioral advertising: We do not sell your personal information for money. However, our use of advertising cookies and pixels (the Meta Pixel and TikTok Pixel) shares online identifiers with those platforms for cross-context behavioral advertising. Under the CCPA/CPRA and similar state laws, this activity may be considered "sharing" (and, in some states, a "sale") of personal information. You may opt out of this advertising-related sharing by:
- Adjusting or disabling cookies in your browser settings, or using a browser/extension that transmits an opt-out preference signal (such as Global Privacy Control)
- Using industry opt-out tools at the Digital Advertising Alliance and the Network Advertising Initiative
- Managing ad preferences directly within your Meta and TikTok accounts
- Emailing us at [email protected] with the subject line "Do Not Share My Information"
To exercise any of these rights, contact us at [email protected]. We will respond to verifiable requests within 45 days, with one possible 45-day extension if reasonably necessary.
California Shine the Light (Civil Code § 1798.83): California residents may request information about our disclosure of personal information to third parties for those third parties' direct marketing purposes. FalcoAlgo does not share personal information with third parties for their direct marketing purposes.
11. European Privacy Rights (GDPR)
If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR), including:
- Right to access your personal data
- Right to rectification of inaccurate data
- Right to erasure ("right to be forgotten")
- Right to restrict processing
- Right to data portability
- Right to object to processing

We may update this Privacy Policy from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the Site after changes constitutes acceptance of the updated policy.
